UnumProvident Proposed Settlement

Aetna Boeing Class Action

On December 14, 2004, a proposed class of Boeing employees filed a lawsuit against Aetna, alleging that the company systematically denied and terminated legitimate disability claims in order to increase profits. This lawsuit was filed by the law firm of Nelson Langer Nelson, PLLC.

The suit alleges that Aetna instituted several bad faith claims-handling practices in its wrongful denial of disability claims. Some of these practices included calling for evidence that the plan did not require, favoring certain subjective evidence to support its denial, and failing to conduct appropriate follow-up testing to confirm disability.

Bonnie Biery, a named plaintiff in the suit, is a classic example of Aetna’s unfair and systematic denial of claims. Despite a variety of treating and independent physician evaluations, which attest to Ms. Biery’s inability to work, Aetna still determined that her disability claim was unsubstantiated.

The suit, filed in U.S. District Court in Washington, is on behalf of a proposed class of Boeing employees in California, Oregon, and Washington who were denied disability benefits from 1998 to the present.
