Re: Class Action Update - Aetna/Boeing

Dear Aetna Claimant:

The court has dismissed the lead plaintiff in a proposed class-action case against Aetna Life Insurance Company (NYSE: AET) and The Boeing Company (NYSE: BA)

We are writing this letter because you have expressed interest regarding a potential Class Action suit pertaining to Aetna's administration of Boeing's Disability Plan. Very recently, the Honorable James Robart entered an unfavorable Order with respect to Boni Biery, the potential named Plaintiff in our proposed Class Action lawsuit. The unfavorable ruling precluded Ms. Biery from being a lead Plaintiff and her claim has since been dismissed.

If you continue to be interested in exploring your rights regarding an Aetna/Boeing disability policy, you need to seek legal representation where you live. What that means is that you should contact an attorney in your area who is familiar with representation of individual ERISA claims. As it currently stands, we are unaware of any other potential for a Class Action lawsuit against Aetna regarding its administration of Boeing's disability benefits at this time.

We were extremely disappointed with this development. We will continue to examine claims emanating from the Puget Sound area to see if there is another potential Class Action plaintiff. Having said that, however, the primary factor driving the Judge's adverse decision was a contractual time bar within the Boeing Plan Documents. Be aware that if your short-term disability benefits have been denied for a period of greater than two (2) years, based on the Judge's ruling, in all likelihood, you will not be able to make that claim. If you have not been receiving long-term disability benefits for a period of greater than three (3) years, based on the Judge's ruling, you may have lost the ability to bring that claim as well.

For the above reasons, I urge you in the strongest possible terms to seek local counsel in your area who is familiar with Aetna's administration with Boeing's disability plans and the entire statutory scheme known as ERISA.
